Josh Rubenstein’s Weather Forecast (Sept. 3)
STUDIO CITY (CBSLA.com) — The weather will be even warmer Monday.
The high pressure ridge that has been the big player for the latter half of the summer…will nudge a little closer to the west Monday.
That’s going to keep us warm inland. It is also making things difficult for firefighters at the Williams Fire.
We are expecting low humidity’s in the San Gabriel and Antelope Valley.
Above 10,000′ however we will see a surge of moisture, that’s going to come in the form of some clouds, but there just isn’t enough to squeeze out a shower or a thunderstorm Monday morning.
The moisture surge will continue through Wednesday, so we will have to monitor the threat of showers and thunderstorms.
Temperatures will stay on the warm side through the rest of the week.
There is no real relief headed our way until next week, and even then it looks like we will only cool down to the mid to upper 80s downtown.

An officer at the nearby West Los Angeles police precinct said there had been no calls about the quake.
The Los Angeles Fire Department says its survey found no significant damage, injury or loss of life in the city.

High Surf Advisory Remains In Effect For OC, SD Coastlines
LOS ANGELES (CBSLA.com) — A high surf advisory remained in effect Sunday for Orange County and San Diego coastlines.
The advisory, which is set to expire at 6 p.m. Monday, forecasts surf heights of 5 to 8 feet with occasional higher sets for Sunday.
The big waves brought dozens of surfers and scores of spectators to Newport Beach on Saturday where a big swell out of the south was producing waves of up to 20 feet.
Most breakers rolled in at 8 to 12 feet.
Elsewhere, along the Orange County coast, the surf was in the 5- to 8-foot range.
No serious injuries were reported though lifeguards made dozens of rescues.
Along the Los Angeles County coastline, forecasters predict the surf breaking at 3 to 5 feet with some sets up to 7 feet on south-facing beaches.
Meteorologist Kaj Goldberg, reporting for CBS2 and KCAL9, says a ridge of high pressure is expected to continue to back into the Southland, bringing with it more summer-like heat by Friday.

Hollywood’s Summer Heads South As Films Fizzle
LOS ANGELES (AP) — Studio executives expected their biggest summer ever this year as they loaded their lineup with huge action movies and superhero franchises.
What they got were two colossal blockbusters, a handful of backup hits and plenty of duds that just didn’t deliver, resulting in what may prove the lowest summer movie attendance in 20 years.
While domestic revenues are projected to come in as the second-best ever, the number of tickets sold shrank to about 532 million from the first weekend in May through Labor Day, down 4 percent from summer 2011, according to box-office tracker Hollywood.com. If that holds by the time final ticket sales are counted through Monday, that would be the smallest audiences Hollywood has packed in for its busiest season dating back to 1993, the earliest summer revenue data maintained by Hollywood.com.
Revenues should finish at $4.27 billion from the first weekend in May through Labor Day, down 3 percent from the record of $4.4 billion set last summer, said Hollywood.com analyst Paul Dergarabedian.
“On paper, the summer of 2012 looked like a clear record-breaker. I think a lot of us were expecting we could beat last summer just based on the titles, the sheer number of blockbuster titles that were in the mix,” Dergarabedian said. “But the audience is what makes and breaks the summer, and they didn’t come out in the numbers we expected for a lot of these films.”
Summer was ending quietly over Labor Day weekend, with overall revenues through Sunday down slightly compared to the same period a year ago. Domestic sales totaled $102 million, off 4.6 percent from last year’s Labor Day weekend, according to Hollywood.com.
The horror tale “The Possession” debuted as the No. 1 movie with $17.7 million from Friday to Sunday, compared to $14.6 million for the top draw a year ago, “The Help,” which joined “Rise of the Planet of the Apes” to give Hollywood a strong seasonal finish that made summer 2011 a record-breaker.
Before this summer arrived, Hollywood was on a box-office tear, with revenues up as much as 20 percent over 2011′s. Studio executives hoped that would continue into summer, when they had what looked like the best lineup they’ve ever offered.
Instead of beating last summer’s record, though, revenues for the season fell for the first time in seven years.
The picture gets worse factoring in higher admission prices. While revenues this time were well above the $3.6 billion haul in 2005, the last time summer dollars dipped, this season’s estimated 532 million admissions is well below the 563 million tickets sold in summer 2005.
In the 20-year span since 1993, Dergarabedian said the only year that comes close to this season’s attendance was summer 2010, when 534 million tickets were sold. A strong Labor Day weekend could put this summer on par with 2010 attendance, but it’s still a soft season considering expectations at the start, when the superhero sensation “The Avengers” launched with a record $207.4 million debut over the first weekend in May.
“The beginning of summer is like the first day of spring training or the opening of football camp. You have to hope your summer’s going to be great,” said Dave Hollis, head of distribution at Disney, which released “The Avengers.” ”But it’s hard to say what’s going to connect or click.”
“The Avengers” took in $618 million domestically and the Batman finale “The Dark Knight Rises” so far has added about $430 million, their $1.05 billion total amounting to nearly one-fourth of Hollywood’s overall summer haul. Worldwide, “The Avengers” has pulled in $1.5 billion, while “The Dark Knight Rises” soon will cross the $1 billion mark.
Summer’s third superhero saga, “The Amazing Spider-Man,” climbed to $258 million domestically, while the animated adventures “Brave” and “Madagascar 3: Europe’s Most Wanted” both were $200 million hits. The raunchy talking teddy bear comedy “Ted” also topped $200 million, and summer produced solid successes with “Men in Black 3,” ”Snow White and the Huntsman” and a few other $100 million movies.
Yet a lot of duds accompanied the hits, with flops such as “Battleship” and “Total Recall” leaving audiences cold. Star power could not pack theaters, either, as fans generally ignored movies featuring A-listers (“That’s My Boy” with Adam Sandler, “Rock of Ages” with Tom Cruise, “Dark Shadows” with Johnny Depp, “The Watch” with Ben Stiller and Vince Vaughn).
The international box office has been Hollywood’s growth area as overseas audiences become more eager for big studio flicks. “The Avengers” did nearly 60 percent of its business overseas. “The Dark Knight Rises” has taken in well over half of its revenues internationally, the reverse of 2008′s “The Dark Knight,” which pulled in most of its cash from domestic crowds.
Domestic summer movie attendance hit a modern high of 653 million in 2002, when “Spider-Man” opened with a then-record $114.8 million. Hollywood has continually climbed to new dollar highs since, but actual attendance has steadily declined as entertainment options expanded with home theater systems, streaming video and endless portable gadgets.
This season, the Summer Olympics siphoned off movie audiences a bit, and the shootings that killed 12 people at a midnight debut screening of “The Dark Knight Rises” in Colorado jolted the industry.
Studio executives say the shootings probably cut into business by no more than a fraction. The tragedy did prompt some moviegoers to think twice about heading to theaters when they have so many entertainment options right at home, though.
The upside for Hollywood is that revenue and attendance for the year is 4 percent ahead of 2011′s, while attendance is up 3 percent. Hollywood hopes to build on that with a strong fall and holiday lineup that includes the James Bond thriller “Skyfall,” the “Twilight” finale and part one of “The Lord of the Rings” prelude, “The Hobbit: An Unexpected Journey.”
Of course, studio bosses had the same hopes for summer before business took a downturn.
“We had a couple of movies ourselves that didn’t meet expectations,” said Dan Fellman, head of distribution at Warner Bros., which released “The Dark Knight Rises” and the surprise hit “Magic Mike” but also stumbled with “Rock of Ages” and “Dark Shadows.” ”There’s the old cliche, nobody starts out to make bad movies. But we are looking at a very strong fall and Christmas ahead.”

‘Possession’ Takes Control In Slow Movie Weekend
LOS ANGELES (AP) — The fright flick “The Possession” has scared up a No. 1 debut with $17.7 million from Friday to Sunday over the long Labor Day weekend.
The Lionsgate release led the last weekend of a fairly quiet season for Hollywood, with attendance down 4 percent from summer 2011, according to box-office tracker Hollywood.com.
Opening in second-place with $9.7 million was the Weinstein Co. bootlegging drama “Lawless,” starring Shia LaBeouf.
“The Expendables 2″ pulled in $8.8 million, falling to No. 3 after two weekends as the top draw at theaters.
Expanding to more theaters, the anti-Barack Obama documentary “2016: Obama’s America” added to its haul as a surprise mini-hit leading up the presidential election. “Obama’s America” was No. 9 with $5.1 million, raising its domestic total to $18.3 million.

AAA: Gas Prices Higher Than Ever Before For Labor Day Weekend
LOS ANGELES (CBSLA.com) — Travelers may find themselves digging deeper into their wallets this Labor Day weekend as pain at the pump continues to mount.
The Auto Club of Southern California (AAA) says drivers will be paying the highest prices ever this holiday weekend.
Video shot over the weekend showed one patron paying a whopping $100 for 24 gallons of gas.
Los Angeles drivers last month paid an average of $3.85 a gallon for regular gasoline.
According to AAA, the average cost of a gallon of gas in Ventura and Los Angeles counties is $4.17, followed by Orange County at $4.15 a gallon and the Inland Empire nearly a penny less at $4.14.
In August, the national average increased just under 31 cents for a gallon of gas — the largest price increase since April of last year.
Art Barron, reporting for CBS2 and KCAL9, says AAA attributes the increase to crude oil costs, regional supply problems in the Midwest and West Coast because of the pipeline disruptions, as well as the Gulf Coast refinery closures in advance of Hurricane Isaac.
AAA predicts that prices should begin to drop slightly this month as Gulf Coast refineries resume operation.

Texting While Driving Law And Virginia Legislature Criticized By Fairfax Judge
Washington Post:
One night in May 2011, Jason Gage, an Alexandria man driving on a road in the Dranesville community of Fairfax County, struck and killed a college student named Kyle Rowley. Authorities later determined that Gage had probably opened a text message about the time of the crash. They charged him with reckless driving.
But when the case went to trial in a Fairfax County court last month, Judge Thomas E. Gallahue ordered the charge against Gage dropped, his texting notwithstanding. The reason: A 2009 Virginia law makes texting while driving a minor traffic infraction punishable by a maximum fine of $20, so texting alone could not be proof of reckless driving.
Melissa Harris-Perry Erupts At Guest: 'I'm Sick Of The Idea That Being Wealthy Is Risky' (VIDEO)
Melissa Harris-Perry erupted at a guest on her show Saturday morning during a discussion on welfare.
Harris-Perry launched a discussion based on a new book titled "Why Americans Hate Welfare" by Princeton professor Martin Gilens.
According to Harris-Perry, the book examines public opinion surveys that found that Americans approve "spending for the social good," but oppose that spending when it's labeled as welfare.
Harris-Perry wondered how this could be the case. "The answer, according to Gilens...[is] that Americans hate welfare because media, at the behest of conservative politicians, have relentlessly linked welfare with black people, and have hammered home the idea that welfare recipients are undeserving."
Harris-Perry contrasted this theory with Mitt Romney's GOP convention speech on Thursday, in which the Republican presidential candidate said that Americans deserve better.
"It does feel to me [that] part of the American story is class mobility. If there is no class mobility, we are not America, right?..And data now shows that in our current moment, class mobility is very low," Harris-Perry said. "I just feel like, from the bottom, you have to be able to say, 'I deserve the ability for class mobility.'"
Financial expert Monica Mehta, who was a guest on Harris-Perry's show, interjected that class mobility is "enabled by taking risk."
Harris-Perry immediately interrupted her and demanded, "What is riskier than living poor in America? Seriously?" After slamming her hand on the table, she continued:
What in the world is riskier than being a poor person in America? I live in a neighborhood where people are shot on my street corner. I live in a neighborhood where people have to figure out how to get their kid into school because maybe it will be a good school and maybe it won't. I'm sick of the idea that being wealthy is risky. No, there's a huge safety net, that whenever you fail, we'll catch you, and catch you, and catch you. Being poor is what is risky. We have to create a safety net for poor people and when we won't because they happen to look different from us, it is the pervasive ugliness. We cannot do that.
During last week's program, Melissa Harris-Perry gave viewers an inside look into her New Orleans neighborhood. Last month, Harris-Perry and her husband closed on the purchase of a home that had been damaged and abandoned after Hurricane Katrina.
Harris-Perry described the property as a site of crime in her neighborhood, so her goal was to rebuild the home and contribute to the safety and security of the community. Harris-Perry called the home "just a physical thing" but also a "symbol of hope."
Just a few days after the segment aired on her MSNBC show, Harris-Perry's new home was destroyed by Hurricane Isaac. "House was vacant except for my dreams," she tweeted.
Watch the clash in the clip above, which comes at roughly 8 minutes into the video.

93-Year-Old Woman Faces Foreclosure On West Hollywood Home
WEST HOLLYWOOD (CBSLA.com) — A 93-year-old woman is facing foreclosure after taking a second mortgage out on her West Hollywood home.
Hilda Vinalas took out a loan after facing financial troubles after her husband, Henry, died.
The couple purchased the home 60 years ago for $30,000 and paid it off in full.
Vinalas told KCAL9’s Amy Johnson she thought the loan, purchased from Lehman Brothers, was a fixed loan for $140,000.
“They made me sign many papers, and I could’ve signed my death sentence because I didn’t know what I was signing,” Vinalas said.
The loan turned out to be an adjustable rate mortgage for $750,000.
“It’s a lot of money. I can’t remember who did it, who took it, nothing,” Vinalas said.
Homeowner activist Suzanne O’Keeffe is helping Vinalas.
“The money went missing. We’re doing an investigating about where it went,” O’Keeffe said. “It was a bad loan. It was an adjustable rate loan. She shouldn’t have gotten it to begin with on her income, and it was the wrong thing to do for an elderly woman.”
The loan has been sold to three different mortgage companies.
KCAL9 reached out to Nationstar, the current loan holder, to ask about the eviction letter they sent to Vinalas, but no one has returned the call.
“They would have to take me out by forcing me. I won’t leave by myself, no,” Vinalas said.
But she’s prepared to get kicked out, just in case.
“I will be happy on the street. I already went to practice to be homeless, but I did this for only three days because it got so cool at night. I couldn’t stand more.”
Man Killed After Losing Control Of Bike At Critical Mass Event
WESTWOOD (CBSLA.com) — A man was killed when he lost control of his bicycle and crashed into a wall on the UCLA campus Friday night.
Jerico Culata, 18, was participating in the Critical Mass ride when his bike slammed into a masonry wall shortly before 10 p.m., police said.
He reportedly took a downhill curve too wide and lost control, according to authorities.
Culata was taken to the UCLA Medical Center where he was pronounced dead.
The Critical Mass cycling event in San Diego also left a police offer injured when a cyclist threw a screwdriver at his head, police said.
Authorities say run-ins with the police during Critical Mass rides are not uncommon.
Critical Mass cycling events are typically held in over 300 cities worldwide on the last Friday of every month.

Jason Kubel’s 11th-inning HR Helps D’backs Beat Dodgers 4-3
LOS ANGELES (AP) — Jason Kubel homered to lead off the 11th inning, helping the Arizona Diamondbacks beat the Los Angeles Dodgers 4-3 after they blew a three-run lead on Friday night for their eighth consecutive win over their NL West rival.
Kubel sent a 1-1 pitch from Matt Guerrier (0-1) into the lower right field seats for his 27th homer. Guerrier was making his first appearance since April 18, having come off the disabled list on Thursday. Kubel was 1 for 24 before he homered, leaving him one shy of tying his career high of 28.
Brad Bergesen (1-0) pitched two hitless innings for the victory. J.J. Putz got three for his 28th save in 31 chances, striking out Matt Kemp and Andre Ethier and retiring A.J. Ellis on a fly ball with runners at the corners to end it as the Diamondbacks won their sixth in a row on the road. They had won the series opener 2-0 on Thursday night to snap a six-game overall skid.
The Dodgers’ losing streak against Arizona ties their longest since dropping eight in a row against the D-backs from July 2-Sept. 29, 2005. They missed a chance to make up ground on NL West-leading San Francisco, which lost to the Cubs earlier Friday, and instead dropped 4½ games back.
The Dodgers rallied to tie the game 3-3 with two outs in the bottom of the fifth on Mark Ellis’ two-run single and Andre Ethier’s RBI single over the head of shortstop Jake Elmore that scored Matt Kemp, who walked and stole second.
Arizona got two runs in the top of the fifth on an RBI single up the middle by pitcher Trevor Cahill and an RBI double by Aaron Hill with two outs.
Chris Johnson’s triple led to the Diamondbacks’ first run in the second after right fielder Ethier lost the ball in the twilight. It fell behind him and he fell down scrambling to recover as Miguel Montero scored.
Cahill gave up three runs and four hits in 5 2/3 innings, struck out four and walked two. Los Angeles starter Aaron Harang allowed three runs and five hits in five innings, struck out three and walked two.
NOTES: The Dodgers turned a season-high four double plays. … Dodgers closer Kenley Jansen threw a 25-pitch bullpen session and plans to play catch Saturday. The right-hander has been out since Tuesday, when he experienced an irregular heartbeat similar to what happened to him last season. He is on blood thinners until at least Monday, and will find out more when he meets with doctors on Tuesday. If they give Jansen the go-ahead to pitch again, he would return to his closer’s role immediately. … With Kemp back in the lineup, manager Don Mattingly flip-flopped Kemp and Adrian Gonzalez in the third and fourth spots, putting Kemp in the cleanup spot for the first time this season. … The Diamondbacks claimed INF Cody Ransom off waivers from Milwaukee. He is scheduled to join the team Saturday when MLB rosters expand. He began the season in the organization and played 17 games before being designated for assignment on May 21. He played 64 games for the Brewers. … Jaime Jarrín, who does the Dodgers’ Spanish-language radio broadcast, will return for his 55th season in 2013 as part of a three-year contract. He holds the second-longest tenure in MLB broadcasting history behind his Dodgers colleague and fellow Hall of Famer Vin Scully.
